Terms of Service

1. Acceptance of Terms

By accessing or using the Miss 28 website and mobile application (the “Platform”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Platform.

2. Use of the Platform

You agree to use the Platform only for lawful purposes. You must not:

  • Use the Platform in any way that violates applicable laws or regulations in Ghana or your jurisdiction.
  • Transmit any unsolicited or unauthorised advertising or promotional material.
  • Attempt to gain unauthorised access to any part of the Platform or its systems.
  • Post false, misleading, or fraudulent reviews or content.
  • Impersonate any person or entity.

3. Accounts

To make a purchase or list products you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at hello@miss28.com if you suspect unauthorised access.

4. Orders and Payments

When you place an order, you make an offer to purchase the product at the listed price. We reserve the right to accept or decline any order. Payment is processed securely through Paystack and accepted via Mobile Money (MTN, Vodafone, AirtelTigo) and major debit/credit cards.

Prices are displayed in Ghana Cedis (GHS) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to correct pricing errors before an order is fulfilled.

5. Shipping and Delivery

Delivery times are estimates and may vary based on your location and the vendor. Miss 28 offers same-day and next-day delivery within Accra, and 2–7 business day delivery for other regions of Ghana. We are not liable for delays caused by circumstances beyond our control, including natural disasters or carrier disruptions.

6. Returns and Refunds

Our returns policy is set out in our Refund & Returns Policy. Please read it carefully before making a purchase.

7. Vendor Marketplace

Miss 28 operates as a marketplace connecting buyers with independent vendors. While we vet all vendors and products, Miss 28 is not the seller of record for marketplace items. Each vendor is responsible for the accuracy of their product listings, fulfilment of orders, and compliance with applicable laws.

8. Intellectual Property

All content on the Platform — including text, graphics, logos, images, and software — is the property of Miss 28 or its licensors and is protected by Ghanaian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Miss 28 shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or any products purchased through it. Our total liability shall not exceed the amount you paid for the relevant transaction.

10. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ghana.

11. Changes to Terms

We may update these Terms at any time. We will notify registered users by email of material changes. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
